Terms of Service

Last updated: 17 October 2026

These terms govern the use of Nuitina, the booking software provided by NOSHI (“we”, “us”). They apply to accommodation businesses that create an account (“you”, the “Hotel”). Nuitina is for business use only.

1. The service

Nuitina is web-based software for hotels, B&Bs, guesthouses and similar businesses: a booking calendar, an online booking engine for your own website, calendar sync with other channels over iCal, guest e-mails, invoices and registration forms, reports, housekeeping lists, and optional online payments through your own Stripe or PayPal account. We provide it at nuitina.com and booking.nuitina.com. The provider is NOSHI, Limmatquai 12, 8001 Zürich, Switzerland.

2. Contract and account

You enter into the contract by creating an account. You confirm that you act for a business and may bind it.

You give accurate information and keep your login details safe. You are responsible for everything that happens under your account, including the people you add (owner, manager, reception, housekeeping). Tell us without delay if you suspect misuse.

You may not create several accounts to obtain repeated free trials.

3. Free trial

New accounts start with a free trial of 30 days. No payment details are needed and nothing is charged.

When the trial ends the account is paused unless we have agreed a plan with you: your booking page stops taking bookings and the back office becomes read-only. Your data is kept as described in section 14.

We may extend a trial, or end it early for good reason, for example misuse.

4. Prices and payment

After the trial the price is the monthly fee published at nuitina.com for the number of rooms you manage, or the price we have agreed with you in writing (for example for houses with more than 25 rooms). Adding rooms changes the fee.

We invoice in advance for each billing period. Invoices are payable within 30 days. Prices exclude VAT, which we add where it applies.

We may change prices with at least 30 days’ notice by e-mail. The new price applies from the next billing period, and you may cancel before then.

If an invoice stays unpaid after a reminder, we may pause the account until it is paid.

5. Your responsibilities

You are responsible for the content you enter (room descriptions, prices, availability, policies, photos) and for having the rights to it; for your prices, taxes, tourist tax and invoices being correct and lawful; for your own booking terms and cancellation policy towards guests; for complying with the laws that apply to your business, including consumer, price display, guest registration and data protection laws; for answering your guests; and for checking your bookings and calendars.

You do not use Nuitina for unlawful content, you do not try to disrupt or overload it, you do not collect data from it by automated means, and you do not resell it without our written permission.

Nuitina is not a party to the contracts between you and your guests.

6. Guest data

You are responsible (the “controller”) for the data of your guests that you enter or collect through Nuitina. We process it on your behalf and only to provide the service, under the data processing terms in part B of our Privacy Policy, which form part of this agreement. We do not use guest data for our own purposes.

7. Channel sync (iCal)

Calendar sync with portals such as Booking.com, Airbnb or Expedia works through iCal links that those providers offer. They publish and read calendars only every few hours, so a short window for double bookings cannot be avoided. We show conflicts we detect, but we cannot guarantee that no double booking arises through a portal. The terms of the portals apply to your use of them. Nuitina is not affiliated with these companies, and their names belong to their owners.

8. Online payments

If you switch on online payments, you connect your own Stripe and/or PayPal account by entering your credentials. Guests pay straight into your account. Your contract is with Stripe or PayPal, and their terms and fees apply to you.

We are not a payment institution. We never receive or hold funds and we charge no commission. We only create the payment page and check with the provider, using your credentials, whether it was paid, so that we can show it in the booking.

You are responsible for refunds, chargebacks, disputes and taxes, and for keeping your credentials valid. We recommend a restricted Stripe key. You can disconnect at any time in the settings; checkouts that are already open may still be paid and will still be shown.

We are not liable for failed or delayed payments or for the actions of the providers, and we cannot guarantee that a payment shown as paid will not be reversed later.

9. Availability and support

We work for a reliable service and make regular backups, but we do not promise uninterrupted availability or an error-free service. We may carry out maintenance, usually briefly. Support is by e-mail at info@nuitina.com with reasonable effort and no fixed response time. Keep your own copy of important data: reports can be exported as CSV in the app, and you can ask us for a full export of your data at any time.

10. Rights in software and content

The Nuitina software, design and brand belong to us or our licensors. You receive a non-exclusive, non-transferable right to use them during the contract.

The content and data you enter remain yours. You allow us to store, process and display them as needed to provide the service, for example to show your room texts and photos on your booking page.

11. Translation helper

Nuitina offers an optional helper that translates the texts you wrote about your house (room names, descriptions, tariffs, house rules) into other languages. When you use it, those texts are sent to Anthropic, our AI provider. Do not put personal data of guests into these texts. You check and change the result before you save it.

12. Liability

Nothing in these terms limits liability for intent or gross negligence, or where the law does not allow a limitation.

Otherwise our liability is limited to direct damage and, per claim and year, to the fees you paid us in the twelve months before the event. We are not liable for indirect or consequential damage, lost profit or lost bookings, or for loss of data that you could have prevented by exporting your data.

We are not liable for third parties such as portals, payment providers, mail and hosting providers, or the internet.

13. Term and cancellation

There is no minimum term. You may cancel at any time by e-mail; the fee stops at the end of the current billing period. During the trial you can simply stop using Nuitina.

We may cancel with 30 days’ notice, and immediately for material breach, misuse, or an invoice that stays unpaid after a reminder.

14. After the contract ends

After the trial or the contract ends we keep your data for at least 60 days so that you can export it or come back. After that we may delete it. You can ask us to delete it earlier, and we will do so within a reasonable time, except where the law requires us to keep records, such as invoices. Export what you need before you cancel.

15. Changes

We may update the service and these terms. For material changes we give at least 30 days’ notice by e-mail. If you do not agree, you may cancel before they take effect. If you keep using Nuitina after that, the new terms apply.

16. Law and courts

Swiss law applies, excluding its conflict-of-law rules and the UN Sales Convention. The courts of Zürich have exclusive jurisdiction, unless mandatory law provides otherwise. If translations of these terms differ, the German version prevails.
